Gallery Terms

Version of 13 October 2026

These Terms add to the General Terms and apply to anyone who creates a gallery, uploads photos to it or views them.

1.The service

The Gallery lets you:

  • create photo galleries for an event, protected by an access code;
  • upload photos as a registered user or as a guest without an account;
  • process images automatically (optimisation, WebP conversion), keeping the original;
  • organise photos into albums (Pro and Business plans) and export them as ZIP;
  • show sponsor spaces, with an anonymous, aggregate count of views.

2.Access

A gallery is accessed through the link or code shared by the Organiser. The Organiser decides whether uploading is open to all guests or reserved to members, and is solely responsible for sharing links and codes.

3.Data processed

Gallery guests are not asked for a name or email. Fotia processes technical data linked to uploads (browser and device type, operating system, IP address) for security and operation; IP addresses are kept for a limited time, as set out in the Privacy Policy.

Photos are not analysed for profiling, nor subjected to facial recognition or biometric processing. Metadata embedded in photos (EXIF) is not removed on upload.

For the photos of their Event the Organiser is the data controller: they are responsible for the lawfulness of the collection and for obtaining the necessary consents.

4.Content and rights

Uploaded content remains the property of whoever uploads it. Fotia acquires no right of commercial, promotional or editorial use over the photographs.

By uploading content you grant Fotia a limited, non-exclusive and temporary licence solely to: store it; process and optimise it; keep the original for download and export; generate ZIP archives; make it accessible within the Event. The licence ends when the content or the Event is deleted.

5.Retention

Photos are kept for the period of the gallery's plan, from a minimum of 30 to a maximum of 365 days from its creation, unless deleted earlier. At expiry, original photos, optimised versions and exports are permanently deleted by automated procedures.

Export download links (ZIP) expire 7 days after generation.

6.Responsibility for content and minors

Whoever uploads content guarantees that it does not infringe third-party rights and that they have the consent of the people depicted.

Protection of minors: the Organiser declares that they have obtained the consent of those holding parental responsibility for every photo depicting minors. Fotia cannot verify such consents and is not liable for them.

7.Reports (Digital Services Act)

Under Regulation (EU) 2022/2065, anyone, even without an account, can report illegal or inappropriate content: illegal content, copyright infringement, privacy violations, harassment, hate speech, non-consensual sexual content, spam or phishing.

  • Acknowledgement: normally within 24 hours of the report.
  • Decision: normally within 7 days (within 24 hours for manifestly illegal content). Fotia may remove the photo, deactivate the Event or reject the report.
  • Notifications: the reporter and the Event owner are informed by email at every step.
  • Appeal: anyone affected by a removal or deactivation can appeal free of charge, via the link received by email.
  • Anti-abuse limits: at most 10 reports per day per IP address.
